Hunt of the U.S. District Court for the Northern District of Illinois pointed out that although the sales contracts for the Nano S and Nano X hardware devices mention the applicability of French law, this clause is not exclusive. The judge determined that since the consumer's allegations do not depend on the applicability or interpretation of the contract, the contract cannot limit the consumer's place of filing a lawsuit.
